All Juveniles that are placed at the Juvenile Detention Facility have the following rights: 1. The Right to Equal Opportunity and Non Discrimination You are guaranteed equal opportunity to participate in any programs and activities offered by the JDU. Administrative decisions will not be made on the basis or your age, national origin, creed or physical handicap. 2. The Right to Privacy All information about you will be kept confidential. Where legal obligations require a staff member to divulge certain information about you, the staff member should inform you of this obligation as appropriate, throughout their professional relationship. 3. Respects for Dignity You are not to be placed in a situation that shows disrespect for your dignity as a human being. You are not to be exposed to unnecessary embarrassment, nor situations in which decision is being made that affect your life and do not have any input. This right does not exclude the possible necessity of using restraints or decisions being made that you do not agree with, however, such actions are only to be taken when security clearly demands it or after your input have been considered by the relevant decision makers. 4. The Right to Professional Services You have the right to receive professional services that are appropriate to your particular problem and are within the authority of the JDU to provide. These services must be provided in a professional manner and at the highest level of quality available within the CNMI. 5. Respects for Beliefs Your religious beliefs or affiliations will be respected. While in the Juvenile Detention Facility, you must be provided on a regular basis the ability to exercise your religious beliefs through worship, prayer, reading, meditation, counseling or any other activity consistent with the Security level setting. You have the right to refrain from activity associated with religious belief systems that you do not accept. Staffs are not to proselytize you, nor ridicule your beliefs, nor apply pressure of any sort upon you because of your beliefs. 6. Right to Healthy Environment While you are being detained at the Juvenile Detention, you have the right to a healthy environment, including necessary medical and dental care, sufficient nutritious meals, adequate supervision, sanitary living conditions, including drinking water and ventilated rooms. 7. Right to Due Process All actions taken by JDU Staff that impose restrictions on your movements or privileges may only be taken for reasonable cause and must be reviewed according to the appropriate disciplinary procedures discussed in this manual. Such procedures should ensure you a fair hearing on the matter. Refer to the grievance procedures in this manual for this issue. 8. Respect for Culture JDU staff must be sensitive to the values and practices of your cultural heritage and reflect those values and practices in the services provided to you. This includes the attempt to provide you with a staff member that is fluent in your primary language and familiar with your heritage. When investigations or reports are done by JDU staff that may have a direct impact on your family, special care will be taken to ensure that the values of your cultural group are not imposed upon another (except when it is done through the force of the law) and that treatment is consistent with the cultural context in which you function. 9. Right to Parental Visitations You have the right to visitation from your natural parent(s), legal guardian(s), or sponsor(s). The location, day and time of the visit will be determined by the JDU staff and will not be restricted unless the parents do not comply with the JDU visiting regulations at the time of the visit or the Juvenile is controlled. 10. Right to Visitation by Legal Counsel You have the right to visitation from your legal counsel. A twenty-four (24) hours notice is required. JDU will determine time, date and location of meeting. 11. Freedom from Assault or Victimization You have the right to freedom from being assaulted or other forms of victimization by other juveniles, staff or anyone else while in the custody of the Juvenile Detention Facility. Resident Responsibilities All youths that are placed at the Kagman Juvenile Detention Facility have the following responsibilities:
Parent's Responsibilities Natural or adoptive parents of youth placed in the Juvenile Detention Facility have the following responsibilities: (a) Your parents are expected to visit you in detention on a regular and frequent basis. Visitations must comply with the facility regulations and schedule. (b) Your parents are expected to provide for you during your stay in detention. This includes providing you with approved personal hygiene items, reading or recreational materials. Personal hygiene items include a toothbrush, toothpaste, shampoo, soap and sanitary napkins. Reading materials include local Newspaper or books (soft cover only). (c) Your parents are expected to cooperate with your rehabilitative and reintegration activities done by JDU. This may include taking part in family counseling, accepting you at home on home visits and providing adequate supervision and attending various activities and meetings that the JDU may conduct from time to time. Resident Dress Code I. PURPOSE To establish understandable guidelines for staff to enforce and for minors who are detained in Kagman Juvenile Detention and Correctional Facility to follow regarding proper attire. To reduce the incidence of theft, assault, sexual harassment, sexual assault or the furtherance of gang, drug/alcohol and/or criminal behavior. II. POLICY A. Kagman Juvenile Detention and Correctional Facility shall only provide the temporary clothing needed to facilitate the booking, shower, and laundry requirements of this Policies and Procedures manual. B. Detainees shall have the privilege of wearing their own clothing and footwear. C. The facility will provide clothing and footwear to indigenous minors. D. All minors shall be treated equally in regard to the restrictions imposed by this Policy Statement. E. Restrictions on or the denial of any clothing shall not be subject to the grievance procedure. F. Minors are responsible for the safety and care of their personal property. G. All clothing must be clean, neat and in good repair. III. PROCEDURE A. The Juvenile Correction Officer III/Shift Supervisor shall determine the appropriateness of any clothing brought into the facility. B. No article of clothing may in any way advocate, demonstrate or display: (1) Vulgar, racial or derogatory statements or sentiments; (2) Display or advertise the use of drugs, alcohol, or weapons; (3) Display or advertise violence or the furtherance of violence or criminal activities; (4) Display or advertise pornographic, sexual or suggestive behavior. C. Residents may not wear shoes or boots having reinforced steel toes at any time. D. Residents may only wear soft sole canvas/leather top athletic shoes or gzoriesh in the facility; E. Dress shoes and work boots shall be stored in personal inventory and be worn as appropriate; F. Minors shall not take footwear into any sleeping room; they shall be left in the hallway; G. No minor may wear see-through or mesh shirts, tops, blouses, etc.; H. Residents may not wear clothing that is sheer or sexually provocative; I. Residents may not wear shorts or skirts that rise above gmid-thighh when sitting down; J. Residents may not wear bikini or Speedo style swimwear; K. Female residents may not wear halter tops, tube tops, spaghetti straps or otherwise go bare shouldered; L. Female residents who have reached a developmental stage where one would normally wear a bra shall wear a bra; M. Residents may wear wedding rings (if applicable), one religious medallion and post/stud earrings. (1) No other jewelry shall be allowed; (2) Culturally specific ornaments may be worn if they do not pose a safety or security threat; N. All minors shall wear underwear under normal outerwear at all times when our of their sleeping rooms; (1) Garments having a built-in glinerh,such as some swimsuits, do not require underwear. O. Residents may not wear sleepwear outside their room except to use the bathroom during the sleeping hours. P. Residents shall be fully dressed when out of their rooms, meaning; (1) Underwear & bra (as appropriate); (2) Pants, shorts, or skirts; (3) Shirt, blouse or other approved top; (4) Shoes or zories; a. Socks shall be worn with shoes. Resident Personal Hygiene I. PURPOSE To establish minimum standards of personal hygiene for minors detained in the Kagman Juvenile Detention and Correctional Facility. II. POLICY A. All minors shall be allowed to shower and shampoo their hair at least once a day. (1) Minors performing work details may be given an opportunity to shower and take care of other personal hygiene as needed. (2) Females shall be given additional hygiene opportunities as needed. (3) Shaving will be allowed unless restricted by the Court for identification reasons, etc. (4) Minors scheduled for Court shall be allowed to shower before leaving the facility. (5) For health and sanitation males shall be given a "military" style hair cut after being detained unless restricted by the court for identification reasons. Females must keep the length of their hair above the shoulder. III. PROCEDURE A. Minors shall be allowed to brush their teeth when they arise in the morning, before going to bed and after each meal. (1) Staff shall organize time and access to bathrooms to maintain Unit security. B. Minors will be allowed their opportunity for monthly hair care services: (1) Staff members may perform the hair care service with parent's permission; (2) Professional hair care services could be provided as part of the facility program. (3) All haircuts shall be documented in the Unit logbook noting who provided the service. C. All hair care equipment maintained by the facility shall be disinfected before use and between use and after use of each minor with a commercially available professional beauty care product or a 10% solution of household bleach and water. D. Shaving will be allowed when time and security is not an issue and not necessarily during shower time. E. When a minor is shaving a staff member shall be present to monitor the use of the razor at all times. (1) The disposable razor will be checked before issuing to the minor and as it is returned to insure the razor is intact. F. All personal hygiene shall be organized in such a way as to preserve Unit and resident security and safety. Staff shall supervise, and if needed provide instruction in the hygiene process. G. Minors shall be required to maintain personal hygiene standards. Failure to shower daily or to brush teeth and/or shampoo regularly shall result in loss of points and room restriction. Resident Work Assignment I. PURPOSE To develop work programs that are meaningful, constructive and related to vocational training that increase a minor's sense of responsibility while being detained at the Kagman Juvenile Detention and Correctional Facility. II. POLICY A. Minors shall be assigned to work assignments based on their security classification and the needs of the facility. B. All work assignment shall be a positive experience and not degrading, nor will they consist of unnecessary tasks. C. Normal housekeeping duties in the facility are required to maintain a clean and sanitary environment. Minors are required to keep their rooms in a neat and orderly fashion. D. All work details shall benefit the facility and not any individual. III. PROCEDURE A. Regular work assignments include food service and laundry; Housing/Living Unit clean up and maintenance of the indoor secure areas of the facility. B. Other work assignments shall be developed based on the needs of the facility. These may include extra cleaning, painting, cleaning facility vehicles, moving furnishings and/or supplies, etc. C. Minors with custody classification Level 1 may work inside and outside the secure boundaries of the facility. D. Custody classification Level 2 minors may work only inside the facility. E. Custody classification Level 3 minors may work only inside a Housing/Living Unit. F. "Seg" or "Temp Seg" classification minors may only clean their rooms. G. Limiting medical conditions shall be considered when assigning minors to work details. H. No minor shall work on any food service detail without a medical clearance. If a minor is released and readmitted to the facility that minor shall have a new medical clearance and the prescribed waiting period before being reassigned to food service work details. I. A staff member shall provide direct supervision of all work assignments and shall provide training regarding the proper procedures for completing the assignments. J. A staff member shall directly supervise the use of cleaning supplies and/or chemicals, and shall not allow those items to be mixed unless the instructions clearly state that two or more specific items can be used together. Resident Grievance Procedures I. PURPOSE To ensure that minors' grievances or complaints are given an opportunity for full hearing, consideration, and resolution, with an appeal process. II. POLICY A. Nothing in this Policy Statement or any action by any employee shall prohibit a minor from filing a grievance relating to the conditions of confinement if the minor believes s/he is being treated unfairly, or from initiating appropriate Court action if the minor believes his/her civil rights have been violated. B. All minors shall be assured access to a procedure that provides an opportunity for a fair hearing and resolution of complaints pertaining to his or her care while in being detained at the Kagman Juvenile Detention and Correctional Facility. C. Formal grievance procedures shall be available to all minors and may be filed by individuals or a group. Any party to a grievance has the right to appeal through the review process. D. Grievances of an emergency nature, i.e., sexual or physical assault or critical time factors shall have immediate recourse to the Juvenile Correction Officer III or facility Supervisor. E. No minor shall suffer reprisal, punishment, or any other negative consequence as a result of filing a grievance. III. PURPOSE A. A minor may utilize the following Grievance Procedure for the resolution of any problem, which arises out of action on the part of staff, behavior on the part of other minors, or regulation, policy or procedure, or any element of the conditions of confinement or unfair treatment while in custody. B. Upon admission to the facility and during orientation, the minor shall be advised of the availability of a Grievance Procedure to resolve issues regarding the conditions of confinement. Refer to Policy Statement 7.08. C. Before filing a Grievance Form, the minor shall first attempt to resolve his/her issue with Unit staff. If the complaint is legitimate and one those staff members have control over, staff members shall attempt to resolve the issue. D. If Unit staff members cannot resolve the issue, the minor shall be given a Grievance Form and the opportunity to complete it. The instructions for the Grievance Form are included on the form, and information regarding the Grievance Procedure is included in the minor's orientation to the facility. Additionally this Policy Statement shall be posted in each Housing/Living Unit. E. The staff member who helps the minor complete the Grievance Form shall not tell the minor what to say, but may only help the minor organize and write his/her own thoughts. F. The minor shall give the completed Grievance Form to a Unit staff member who shall immediately cause it to be delivered to the Juvenile Correction Officer III on duty. G. The minor must talk with the Juvenile Correction Officer III on duty before the end of the shift. (1) If the Shift Supervisor on duty is the on-coming Shift Supervisor before the end of that Supervisors shift must interview a party to the Grievance the minor. a. A Grievance must be review by a Juvenile Correction Officer II or higher authority. (2) The minor must be interviewed by a Shift Supervisor within 24-hours of delivering the Grievance to a Unit staff member. H. The Juvenile Correction Officer III/Shift Supervisor shall: (1) Review the Grievance Forma and conduct and investigation necessary; (2) Attempt to determine if the complaint is legitimate, and if so, how to resolve the issue; (3) The investigation and propose resolution shall be completed before the end of the shift, whenever possible, unless the issue is too complex to be resolved quickly; (4) Discuss the compliant and the proposed solution with the minor and implement the solution if there is one; (5) The minor shall be allowed to present additional information verbally is s/he wishes; (6) Record the solution and the reason(s) on the Grievance Form; (7) If there is no basis for the complaint, record the investigation and that the complaint was unfounded; (8) Indicate on the Grievance Form whether the minor was satisfied; (9) Sign the Grievance Form and give it to the Facility Supervisor. I. The Facility Supervisor or designee's response to the Grievance, within 2 business days if receipt shall: (1) Review the Grievance Form and the Juvenile Correction Officer III's response; a. If the matter has been resolved satisfactorily, sign the form accordingly; (2) If the minor was not satisfied with the Shift Supervisor's response, conduct any additional investigation that may be appropriate, and determine whether an alternate solution is possible; (3) Discuss the compliant, findings, and any new solution with the minor, and implement the new solution if there is one; (4) Record the new solution on the Grievance Form along with the reason(s) or a statement that the Juvenile Correction Officer III's response was appropriate; (5) Indicate on the Grievance Form whether the minor was satisfied with the solution; (6) Sign the Grievance Form, place the original in the minor's facility file, give a copy to the minor, and retain a copy for two years in a file designated for that purpose. J. If the Facility Supervisor or the designee was involved in the circumstances that resulted in the grievance, the matter shall be referred up the chain-of-command to an administrator who was not directly involved in the circumstances. K. If the minor is not satisfied with the response of the administrator(s) at the Kagman Juvenile Detention and Correctional Facility the minor may take the Grievance up the chain-of-command as far as the Secretary, DCCA L. If the minor has exhausted all administrative remedies and still believes s/he has a legitimate complaint that has not been resolved through the Grievance Procedure, the minor shall be advised to consult his/her attorney about other alternatives. Disciplinary System While you are in Kagman Juvenile Detention and Correctional Facility, you must obey all rules and all staff instructions. If you do not obey, you may lose privileges, you may be confined to your room, or you may even have new criminal charges filed against you. Most of the information you need to know is in the Basic Information for Minors that has been given to you. This information sheet will tell you more about the discipline process within Kagman Juvenile Detention and Correctional Facility. It will not cover every possible situation that could occur. The most common behavior problems are posted in each Unit and listed in the Basic Information for Minors. You should be able to determine what other actions are acceptable or not acceptable. Classification of Violations: Rule violations are classified as Major or Minor. Major violations usually involve violence, security issues or other serious behavior. Minor violations usually involve less serious behavior, such as approaching the desk without permission, using foul language, and other similar behaviors. Some violations can be major or minor depending on the individual circumstances. For example, failing to follow instructions would be a minor violation if you were slow to line up for dinner, but would be a major violation if you failed to drop to the floor after a warning that OC spray would be used. Damage to property can be major or minor, depending on the amount or type of damage. Any minor behavior can be considered major if youve been warned about the behavior and you continue or repeat the same behavior. Also, several minor violations in a short period of time can be classified as major even if they are different kinds of violations. Consequences for Violations: The smallest consequence for a wrong behavior is a warning and/or counseling from a staff member. You will receive a warning if the behavior is not too serious or if the staff member believes you might not know the behavior is not acceptable. Once you have been warned, you must stop that behavior and not repeat it. You are also expected to know that similar behavior is not acceptable. For example, if you were warned for using foul language, you should know that different foul language is also not acceptable. The most common consequence for wrong behavior is room restriction, which can be for any number of hours or days, depending on the violation. Room restriction is called Disciplinary Restriction or DR. You can get up to 24 hours of DR for a minor violation, and more than 24 hours for a major violation. You can expect to receive more consequences if OC spray is used to break up an incident. You will be told how much room restriction you will receive for each violation. If you are considered a threat to yourself or others, or if your behavior is disruptive, you could be placed on room restriction until you start to cooperate. This is called Temporary Segregation, or Temp Seg. If you are placed on Temp Seg, a supervisor will review your status at least once every day to see if you are ready to cooperate. You may have to serve a specific amount of DR for a violation and then stay on Temp Seg until you are no longer a threat to yourself or others, or until you are no longer disruptive within Kagman Juvenile Detention and Correctional Facility. If the judge orders you to serve a specific number of days within Kagman Juvenile Detention and Correctional Facility as a commitment, you can earn conduct credits for following facility rules. This means you could serve less time within the facility than the Judge ordered if you behave. If you violate rules you could lose some or all of the conduct credits and spend your entire commitment within Kagman Juvenile Detention and Correctional Facility. For both major and minor violations, you will almost always lose points on the point system. Points are used to decide your bedtime every day and for other privileges such as canteen purchases and phone calls to your parents. You could also be required to complete extra work duty or a writing assignment, or you could lose privileges such as having books or magazines in your room. The most serious consequence for wrong behavior is that new charges could be filed against you if the behavior is a law violation or a violation of your probation. For example, if you assault a staff member or another minor, you could be charged with assault or battery, and you would have to go to Court on the new charges in addition to the charges that brought you to the facility. In a single incident, you can receive both the facility consequences for violating a facility rule and legal consequences for violating a law. Staff members are peace officers and assaulting a peace officer is a felony. How the disciplinary process works: If you do something wrong or if a staff member has good reason to believe you have done something wrong, the staff member who witnesses or discovers the behavior will tell you what you did wrong. If the consequence will be more than a warning or loss of points, the staff member will give you a copy of a Discipline Report stating the violation and the recommended consequence. The staff member will write an Incident Report that gives the details of the incident. A supervisor will review the Incident Report and Discipline Report and will approve or modify the consequence. The consequence will depend on the seriousness of the behavior, how much you were involved in the incident, and what your behavior was like before the incident. If you are accused of a major or minor violation and you think you are not guilty, you may ask for a Hearing Form. You may ask a staff member to help you fill out the form. The staff member may not tell you what to say, but may help and organize and write your own thoughts. You will be given some time out of your room to complete the form. A supervisor will review the form, talk to you and any witnesses, and decide your guilt or innocence. You may not have a hearing for a minor violation. If you are disciplined for a major or minor violation and you do not think the consequence is fair, you may ask for an Appeal Form. You may also ask a staff member to help you fill out the form. The staff member may not tell you what to say, but may help you organize and write your own thoughts. The Appeal Form is not to decide guilt or innocence, just whether the consequence is fair. A supervisor will review the form and respond to you. You may not appeal a loss of points. After the Supervisor has reviewed the case, a Juvenile Hall administrator will review all Incident Reports, Discipline Reports, Hearing Forms, and Appeal Forms to make sure everything was done right. The administrator might change the consequence if he or she decides a different consequence is more appropriate. You will be told if a consequence is changed. There is a list of sample violations and possible consequences posted in each Unit. The Basic Information for Minors includes additional facility rules. Neither one is a complete list of violations, but it will give you an idea of what kind of behavior is not acceptable. If you have any questions about how to behave within Kagman Juvenile Detention and Correctional Facility or any other possible consequences for violating the rules, please ask a staff member. NOTICE TO MINORS: DISCIPLINE GUIDELINES The following list includes some of the behaviors that are not allowed in the Kagman Juvenile Detention and Correctional Facility and the possible consequences for the behaviors. You will also lose points for any violation. This is not a complete list of behaviors and consequences, but will give you examples of unacceptable behavior. It is also important for you to read your Basic Information for Minors. You should be able to determine for yourself what other behaviors are not acceptable. The consequences for each violation will be determined individually. Stall will consider the seriousness of the behavior, how much you participated in the behavior, how you have behaved in the past, and other factors in deciding which consequences are right for your behavior. If OC spray is used to stop your behavior, you can expect maximum consequences. Staff members are peace officers, and assaulting a peace officer is a felony. Basic Information for minors Please read all of the information on this page. If you have any questions or you do not understand something, ask a staff member. Do not ask another minor, because you may receive wrong information. Legal: You are being held in Kagman Juvenile Detention and Correctional Facility because you have been accused of a crime or a violation of probation. If you do not have an attorney, one will be appointed for you if you go to Court. You will be here until the Court or the Probation Officer releases you. The staff members at facility are here to make sure you and the other minors are safe and are treated fairly and that your needs are met. They cannot give you legal advice and cannot get you released, but they will help you contact your attorney or your Probation Officer if you ask for a "kite." They will also help you if you have any problems with other minors in custody or if you think someone is treating you unfairly. Behavior: You must obey facility rules and follow staff instructions at all times. Treat staff members with respect. Do not use profanity, threats, or gestures toward anyone, and follow staff instructions immediately. If you do not obey, the penalty could be early bedtime, loss of privileges. Room restriction, additional time in the facility, or new criminal charges. The most serious violations are those that threaten the safety and security of the staff and other minors, such as assaulting staff members or other minors, fighting, threatening others, and attempting to escape. The best rules to remember are "Don't touch anyone or threaten anyone, don't damage property, keep your language clean, and obey staff instructions immediately." The Discipline Guide will tell you how the discipline process works. If you are considered a threat to yourself or others, you may be restricted to your room (Temp Seg) until you are no longer a threat. A supervisor will review your status every day to determine if you still need to be segregated from the other minors. Your attitude and behavior will determine when you are no longer on "Temp Seg." Use of Force: If any minor is out of control, staff will first attempt to gain control by talking to the minor. If the minor continues to act out, staff members may use OC spray (Oleoresin Capsicum), hands on controls, or physical restraints. Staff members have been trained to use the least force possible to control situations. OC Spray: Staff members carry OC spray (Oleoresin Capsicum) and have been trained to use it if necessary. OC spray causes a burning feeling in the eyes, nose, mouth, and throat and on the skin. If any minor is acting in a dangerous manner, staff members will warn you that OC will be used and will instruct the entire Unit to "hit the floor." You must lay face down on the floor with your hands behind your back, even if you are not involved in the incident. Stay face down on the floor until a staff member instructs you to get up. If you do not obey, a staff member will warn you that OC spray will be used. If you still do not obey, you will be sprayed with OC spray. After an incident, staff members will care for anyone who was sprayed with OC. All other minors will be locked in their rooms until aftercare is completed. Point System: You will earn points each day based on your behavior and attitude. Privileges, including bedtime, depend on the number of points you earn. Average behavior means an average number of points and average privileges. Your behavior must be better than average to earn high points and extra privileges. Once a week you may redeem your points for Canteen items and extra phone calls to your parents. A more complete explanation of the point system is posted in each Unit. Movement: Do not enter any room or cross any painted lines in the Units or yard without permission. When you move from one place to another in the facility, walk in line with your hands behind your back. Go directly to the proper place. Do not talk, make other noises, horseplay, or touch anyone while walking. During fire drills, remain quiet and follow staff instructions. Staff members will transport you to Court in handcuffs and shackles. Follow staff instructions while handcuffs and shackles are being attached and removed. At the Court building Marshals may supervise you. Obey their instructions. Bathrooms: Do not enter the bathroom without permission from a staff member. Finish your business quickly and quietly. Wipe up after yourself and pick up your own towels, clothing, and grooming items. Housing: You may be assigned to a room with or without a roommate. Staff will attempt to house you with minors who are similar to you in age, size, and offense history. Your room should be clean and free of damage or contraband. If you find any problems, notify a staff member right away, because you will be held responsible for any damage, dirt, and contraband found in the room later. You must clean your room daily and make your bed neatly each time you leave your room. You may have no more than three books or magazines and a Bible at any time, and you may have a deck of cards, your mail, legal papers, this information sheet and the Discipline Guide. You must keep all items stacked neatly. Do not cover the door window, room light, and air vent or outside window with anything. Leave the locks, light fixtures, and air vents alone. If you have a roommate, you are both responsible for the condition of the room. While you are in your room, you may read, play cards, or talk quietly with your roommate. Do not yell, bang on your door, create any disturbances, or talk between rooms. Do not fight, horseplay, or engage in sexual activity with your roommate. If your roommate does not follow the rules, ask a staff member to move one of you to a different room. If you need to use the bathroom or talk to a staff member, call out and a staff member will respond. Staff members are sometimes busy with other responsibilities and will get to you as soon as they can. Contraband: Contraband is any item that is not approved by staff. Contraband includes drugs, alcohol, cigarettes, tobacco, matches, weapons, betel nut and sharp items, any item that could be used to harm a person or property, gum, and similar items. Pencils and pencil lead may be used in the activity room, but may not be in rooms. Do not pass notes or accept notes from other minors. If unsure, ask a staff member before taking anything to your room. Clothing, Property, Hygiene: Your own clothes and personal property will be kept by you unless they are needed as evidence in your case. You will be given, grooming items, bedding, and towels. Keep yourself well groomed and shower daily unless you have a medical excuse. Do not make any marks on your body. You must wear a shirt in the Unit at all times, but boys may remove their shirts during yard activities if they have staff approval. Your clothing should be clean and must fit properly. Do not use anything to tie up your pants. Do not tuck your pants into your socks. Fold up the pant legs if they are too long and do not let them drag on the floor. If you wear a sweatshirt, you must have a T shirt underneath, but you may not wear a T shirt over a sweatshirt. Do not damage or destroy clothing. Care of Property: Do not damage or destroy any property belonging to the facility or any staff member or any other minor. Do not write or make any kind of marks on anything except paper or school materials that are provided for that purpose. Do not write or draw any gang drawings, gang slogans, gang emblems, profanity, anything of a sexual nature, or anything supporting drugs, alcohol, or violence. Meals: Each day you will be served three meals that meet all nutritional requirements. Follow staff instructions regarding how to line up and where to sit for meals. Sit at the table until excused, and use proper table mariners. Talk softly unless you are instructed to remain quiet, and do not engage in horseplay. Do not give food to or take food from another minor. After meals, follow instructions for using the bathroom and going to your room. Activities and Programs: Each Unit has a television, a small library of books and magazines, cards and some games. Gambling is not allowed during any activities. Local churches provide religious programs. Programs addressing substance abuse, health issues, parenting skills and other topics are presented when available. Recreation yard: In good weather, you will be taken to the yard daily if there is enough staff. Use the restroom before leaving the Unit. Follow staff instructions for going to and from the yard. Do not take food or reading materials to the yard. If there are organized activities, such as exercises or games, you must participate unless you have a medical excuse. Do not touch other minors except in the normal activity of the game. Do not go near the fences, gates, or Unit windows. Do not spit or horseplay. If you do not obey yard rules, you may lose yard privileges. Visiting: Your parents, legal guardians, and grandparents may visit you on Sundays from 1:30 PM to 3:00 PM and Wednesdays form 7:00 PM to 8:00 PM. No other friends or family may visit. Your attorney or Probation Officer may visit you at any time, and you priest, minister, rabbi or counselor may make arrangements to visit you. Do not accept anything form your visitors during visiting. They may leave soft-covered books, magazines, envelopes, stamps, and new (sealed) decks of cards at the Visiting Reception Desk for you. These items must be left at the facility when you are released. Books and magazines will not be accepted if they contain violent, sexual or anti-social material. Mail: You may send and receive mail but there are restrictions. A staff member will open your mail in front of you and will check all incoming and outgoing mail for contraband. Your mail may not contain racial or sexual slurs, threats, escape plans, or anything promoting criminal behavior. Staff may read your main if they believe there is a safety or security problem. Incoming mail must come through the US Mail and must contain a complete return address including the sender's name. You may not receive mail from another custody facility unless the mail if from your parent. For outgoing mail the facility will provide you with paper and pencils, but you must provide envelopes. You may send as many letters as you want. Address letters clearly, and write your name and the facility's return address in the left corner of the envelope. Give your unsealed letter to a staff member to check. You must provide you own postage after the two letters a week the facility provides, but you may send letters to your attorney free of charge. To obtain free postage, write "Free" in small letters where the stamp belongs on the envelope. A staff member will make sure you are eligible for free postage and will send the letter for you. Phone Calls: You may call your parent or employer when you first come to the facility, and you may call your attorney if you have one. After that, you may call your parent if you earn enough points on the point system, which is explained above. You may call your attorney at any time. You may not receive phone calls except from your attorney or Probation Officer. School: You will attend school every school day unless you are sick, in Court, or on room restriction. Use the restroom before leaving the unit for school. Your school records will be reviewed, and you will be given work that is at your grade level. You must cooperate with school staff or you will not be able to attend school with the other minors and you might lose other privileges. You must turn in all school materials every day. All facility rules apply in school also. Medical: You will have a physical within the first few days you are here. If you have any medical or mental health problems at any time, notify a staff member. If the problem can wait, the staff member will put you on the Nurse's List or refer you to Mental Health Staff. If the problem is an emergency, you will be taken care of immediately. If you have any contagious condition, you may be restricted to your room (Med Seg) until medical staff clears you. Grievances: If you believe your rights have been violated or a staff member has treated you unfairly, ask a staff member for a Grievance Form. Follow the instructions on the form and return it to a staff member. A supervisor will review your grievance and respond to you. Be patient. The supervisor may have to do some investigation before giving you an answer. If your complaint is found to be true, the supervisor will take action to see that the problem is corrected. |
